LIMITED WARRANTY

All camera support products sold by Intel-A-Jib / a division of Industry Advanced Technologies, Inc. (“IAT”) are sold with no implied or express warranties other than as follows:

IAT warrants the products manufactured by it will be free from defects in material and workmanship under normal use for a period of twelve (12) months following the date of shipment. If any of the products are found by IAT to be defective, such products will, at IAT’s option, be replaced or repaired at IAT’s cost. Buyer’s sole and exclusive remedy shall be to seek the repair or replacement of the defective product or part in the prescribed manner. The foregoing warranty is in lieu of all other warranties, and IAT’s warranty does not apply to any products after acceptance by buyer that have been modified, altered or repaired by anyone other than IAT or one of IAT’s authorized agents (including but not limited to any unauthorized modification, the use of unauthorized parts or attachments), or any damage caused by acts of God, abuse, misuse, intentional damage, improper usage or maintenance, cosmetic damage, or damage caused by persons who have not been trained in the proper use of the product, or continued use of the product after discovery of defect.

Any claim by buyer with reference to the products sold hereunder shall be deemed waived by the buyer unless submitted in writing to IAT within the earlier of (a) thirty (30) days following the date buyer discovered or by reasonable inspection should have discovered any claimed breach of the foregoing warranty, or (b) twelve (12) months following the date of shipment. Any cause of action for breach of the foregoing warranty shall be brought within one (1) year from the date the alleged breach was discovered or should have been discovered, whichever occurs first.

IAT’s liability (whether under the theories of breach of contract or warranty, negligence, or strict liability) for its products shall be limited to repairing or replacing product or parts found by IAT to be defective, or at IAT’s option to refund the purchase price of such products or parts thereof. At IAT’s request, buyer will send, at buyer’s expense, any allegedly defective products, or parts to the plant of IAT, which manufactured them.

In no event shall IAT be liable for incidental or consequential damages arising out of or in connection with this warranty, including, without limitation, breach of any obligation or warranty imposed on IAT hereunder or in connection herewith. Consequential damages for purpose hereof shall include, without limitation, loss of use, income, or profit, or losses sustained as the result of injury to any person, or loss of or sustained as the result of work stoppage, or transportation, shipping or insurance charges, or costs associated with set-up, removal, or installation. Buyer shall indemnify IAT against all liability, cost, or expense, which may be sustained by IAT on account of any such loss, damage, or injury.
